Nike Responds to Verdict in Odell Beckham Jr. Trademark Infringement Case

In a statement posted to his social media accounts on Thursday, Odell Beckham Jr. reflected on the conclusion of his $20 million lawsuit against sportswear giant Nike. The suit, which had been pending for several months, reached a settlement the previous day.

Beckham expressed his gratitude to his legal team and his supporters for their unwavering belief in him throughout the legal process. “I’d also like to thank the fans who stood by me,” he said. “Your encouragement and support meant the world to me.”

The lawsuit, which Beckham filed in March 2022, alleged that Nike had failed to honor its contractual obligations to the star wide receiver. Beckham claimed that Nike had withheld bonus payments and royalties, and had also breached a confidentiality agreement.

The settlement terms were not disclosed, but Beckham expressed optimism about the future. “I’m excited to move on from this and focus on the upcoming season,” he said. “I’m confident that I can continue to be a positive force in the NFL and make a difference in the community.”

Nike and Beckham became embroiled in a legal dispute over a 2017 endorsement deal. Nike exercised its right of first refusal to match an offer from Adidas, prompting Beckham to sign with the latter. However, after a thorough examination of the contractual obligations between sportswear giant Nike and renowned footballer David Beckham, a jury in the Multnomah County Circuit Court in Oregon has determined that Nike has not breached the terms of their agreement. The jury meticulously reviewed the evidence presented in the case, specifically focusing on allegations that Nike had withheld royalties, customized Mr. Beckham’s football gloves to conceal the Nike logo, and disclosed confidential contract details to third parties.

The jury also considered the allegation that Nike had customized Mr. Beckham’s football gloves to obscure the Nike logo, allegedly violating the exclusivity of the agreement. However, the jury determined that Nike had the authority to make such modifications, as long as they did not materially impair the gloves’ functionality or otherwise diminish their value to Mr. Beckham.

Finally, the jury examined the claim that Nike had shared confidential contract details with third parties, potentially exposing information that should have been kept private. The jury found that there was insufficient evidence to support this allegation, and that Nike had acted in accordance with its obligations to maintain the confidentiality of the contract.
